For the purposes of this Program, A NICKSON Member (“Member”) is defined as a NICKSON Living Plan subscriber. Individuals who have created a NICKSON account but are not subscribers shall be referred to as (“Non-members”). The Program is open to all Members and Non-members who are of the legal age of majority in the state in which they reside. NICKSON Employees are not eligible to participate in this Program.

NICKSON Members shall be eligible for cash and swag bonuses. Non-members shall only be eligible for cash bonuses.

To receive credit for a referral under the Program, eligible referrers must create a Referral account, receive their unique referral codes, and send the relevant code(s) to the people whom they intend to refer to NICKSON for a Living Plan subscription, and the person(s) referred must subscribe to a NICKSON Living Plan subscription that remains in effect longer than their risk-free cancellation period.

By referring friends via email you agree to allow us to send an email on your behalf giving your friends the opportunity to apply for a NICKSON Living Plan. Your friends' email addresses will only be used for this offer and will not be used for any other marketing solicitations or sold to third parties. If your friend already has a NICKSON account, is on our opt-out list or the national email opt-out list, lives in a state where NICKSON is not licensed, has already received a unique referral code, or if the email address you provided is incorrect or no longer valid, your friend may not receive the email. Due to the confidential nature, we cannot disclose any information about the reservation submitted by the friends you invite. Participation in this Program serves as a one-time waiver of privacy rights by both parties, whereas each may be aware of the presence of an account relationship.

In order for the referrer to receive credit for cash bonuses, each recipient must use create a NICKSON account, enter their referrer’s unique code during checkout, and then proceed all the way through purchasing and installing a NICKSON Living Plan. Cash bonuses will NOT be awarded for the creation of NICKSON account or any attempted reservations which do not result in a Living Plan installation.

Only one cash bonus will be awarded for each referred Member, regardless of whether the Member subsequently completes multiple NICKSON reservations. Members and Non-Members are limited to 50 cash referral bonuses in any preceding 12-month period and 200 total lifetime cash referral bonuses. Referrers will NOT receive a cash referral bonus for a new referral if they have received 50 cash referral bonuses in the preceding 12 months or if they have received 200 total lifetime cash referral bonuses. Referral bonuses are considered miscellaneous income, and may be reportable to you and the IRS on Form 1099-MISC (or Form 1042-S, if applicable). A referrer will not earn a referral reward if their referred friend has an existing NICKSON account or if their referred friend does not use their unique referral code.

Referrers will not receive credit for referring themselves or for submitting a reservation using their own unique referral code. Referrers are limited to referring their own friends, colleagues, family members, and direct acquaintances whom they believe may be eligible for a NICKSON Living Plan. NICKSON reserves the right to disqualify anyone from this Program at any time. Anyone who violates these official rules is ineligible for payment of any bonus.

The Program supports referrals to NICKSON Living Plans only and no payments will be made for referrals to other NICKSON products.

If you participate in the Program you agree not to solicit applications for any type of NICKSON Living Plan. You agree not to compensate, or accept any compensation from, applicants whom you refer to NICKSON through the Program. You further agree that your activities will be limited to informing your contacts about NICKSON’s Living Plans so that they may independently decide whether or not to purchase a NICKSON Living Plan. You may not collect information from your contacts or assist with filling out a NICKSON reservation.

You must comply with all applicable laws and regulations, including anti-spam laws. Any distribution of a Program code, including by email or social media, must be done in a personal manner and must be in a form approved by NICKSON in advance. Bulk email distribution and any use of automated devices or third-party services is prohibited. Program links should only be sent to your own friends, colleagues, family members, and direct acquaintances whom you believe to be eligible for a NICKSON Living Plan. Participants may not purchase internet search terms or publicly advertise NICKSON”s Living Plans, products, or name in any fashion. Further, any distribution of a Program code that could constitute unsolicited commercial email or “spam,” any content which impersonates or implies an affiliation with or endorsement by NICKSON or any NICKSON subsidiary, or any actions which otherwise violate any conditions imposed by NICKSON, are prohibited and will be grounds for immediate termination.

This Program replaces all earlier versions of the NICKSON Referral Program. NICKSON reserves the right to temporarily or permanently modify or discontinue the Program at any time, for any reason, at our sole discretion, and without notice to you.
